Tasks
Tasks of the Inspectorate on the protection of personal data and public information:
1. legal assistance and supervising
- councelling and clarification
- examination of complaints
- examination of challenges
- sending memoranda for solving concerns
- requiring explanations and executing inspection
- participation in joint supervisory activities of European Data Protection organisations
2. approval of the data bases of the public sector
- approving the foundation documentation of data bases of the state and of the legal person governed by public law;
- approving the changes of the position of the data in the abovementioned data bases.
3. registration of processing the sensitive personal data
- processing of sensitive personal data has to be registered with the Data Protection Inspectorate by the processor or
- information about the appointment of the person responsible for processing has to be delivered to the Data Protection Inspectorate.
4. authorising the data processing
- authorising the data processing for scientific or statistic purposes without the consent of the person,
- authorising the transmission of personal data to foreign countries with insufficient level of data protection.
5. implementation of the administrative compulsion and responsibility
- issuing precepts;
- determination of penalty payment;
- implementation of security measures on the expense of the processor in cases of urgency;
- entering a protest in the administrative court against the state institutions in case of misobservancy towards the implemented preciptions;
- determination of pecuniary punishment in misdemeanour procedure
6. formation of good practices
- participation in international working groups to standardize the implementation practices;
- giving instructions of advisory nature for interpreting legal provisions;
- carrying out awareness rising functions (organizing round tables, conferences, publishing informational materials);
- submitting the annual report on compliance of Public Information Act and personal Data Protection Act containing proposals to the Constitutional Committee of the Parliament and to the Legal Chancellor.
